In light of the manuscripts in the British archives which in recent years have so vastly increased our knowledge of Colonial Virginia, the event known as Harvey's "Deposition" from the government assumes an importance second to none in American history. It was the culmination of the noble protest of William Claiborne against the spoliation of Virginia territory by the grant to Lord Baltimore. There was something monumentally audacious in the seizure of the Governor and returning him back to the master who sent him; and any further light, therefore, upon the prime

actor of the measure must be interesting. This man was Captain John Utie, of the Virginia Council, who at the Council Board retorted the charge of treason on Harvey, and thus was the first to take a decisive step towards his arrest. It has recently been found that the wife of Richard Bennett in 1641 was Mary Anne Utie, and she perhaps was a daughter of Captain John Utie. But if so, she must have been lately married, as in 1625 John Utie was living on Hogg Island with only his wife Anne and son John. She is referred to, however, as "lately Mary Anne Utie". Captain John Utie patented 100 acres in 1624 in Chippoak's Creek in Surry county. He was then called "Ensign Utie". Burgess for plantations between Archer's Hope and Martin's Hundred, October, 1629; for Hogg Island, 1629-'30; member of the Council 1631- '35, with the title of captain; in 1632 received 600 acres for planting Chiskiack. He settled at the mouth of King's Creek, and called his home "Utimaria". One of the first justices of York county, court being frequently held at his place. A patent of John Utie, "son and heir of Capt. John Utie, dec'd", shows that he died in 1639, or before it. There are several joint deeds ofJohn Utie, Jr. (whose wife was Mary), and Robert Booth (clerk of York county) for land in "Utimaria," on King's Creek neck. In 1658 Richard and Mary Anne Bennett, of Nansemond county, made a deed for land in Essex county. (Hotten's Immigrants; Hening's Statutes; Norfolk, Essex, and York counties' Records).
John Utie, Jr., disappears from the Virginia records about 1645, and soon after the names of Nathaniel Utie, who became Councillor, and George Utie, his brother, appear in Maryland, to which they may have emigrated, as did hundreds of the party of Claiborne and Bennett. It appears, too, that a daughter of George Utie was called Mary Anne Utie.
Professor Christopher Johnston has made a very full search in the Maryland records and his work is given below, with the following commentary by him:
"You will observe that Richard Bennett assigns (20 Oct. 1658,) to Nathl Utie 350 acres in Town Neck, Ann Arundel Co. - This land was composed of a number of grants - head-rights as you call them in Virginia - to persons who had settled there during the Puritan immigration, and which had been acquired by Bennett. The connection of Bennett & Utie here seems to bear out the theory of the former's marriage with Mary Ann Utie; as does also the deed from Nathl & Mary Utie (16 April, 1663) to Richd Bennett, Jr.
"I cannot exactly place Bernard Utie, although hemust have been a relative. He was certainly living in Baltimore county as early as 1668, and died in April 1675. His "cousins" Jean, John, and Nathaniel Overton were proba-

bly his niece and nephews, and his "brother" Thomas Overton may have been his half-brother or may have married his sister. Note especially the name Nathaniel Overton, who may have been named for Col. Nathaniel Utie. It seems pretty clear that Bernard must have been either brother or nephew of Col. Nathaniel and George Utie, but evidence is wanting to establish the relationship more precisely, and without evidence conjectures are useless".

Residence: Utimaria, Chiskiack District, 1630, York County, VA. Page 64 YORKTOWN. On October 8, 1630, the Council of Virginia determined to plant a settlement in the Indian district called Chiskiack, on the south side of York river. The leaders of the settlers were two councillors, Captain John Utie and Captain John West, brother of Lord Delaware, who were allowed 600 acres apiece on York river, on opposite sides of the mouth of King's creek. Captain Utie settled at "Utimaria," on the west side, and Cap- tain West on the east side, at a plantation afterwards called "Bellfield." Other settlers ranged themselves on the river on either side of Utie and West, and soon there were two parishes, (seal)

Chiskiack and York. Two years later, in 1632, palisades were run by Sir John Harvey across the peninsula from Archer's Hope creek ot Queen's creek, six miles long, and Williamsburg (first called Middle Plantation) was built within the centre of the line of palisades. In 1633 was born, at "Bellfield," John West, Jr., founder of West Point, the first child born on York Page 65 river. In 1634 the colony was formed into eight counties, and Charles River county (afterwards York county) was created, taking in the plantations on the York. Court was held for many years at the different large plantations, but about 1660 it began to be held regularly on the west side of Wormeley's creek, at a place called "York," first established by Sir John Harvey. After- wards, about 1676, court was held at the "Half-way House," on the road between Yorktown and Middle Plantation. In 1691 fifty acres of the estate of Benjamin Reade, on York river, was bought for a town called Yorktown, and in 1698 the court re- moved to the place which was about three miles above York. Yorktown continued to develop until the incident occurred which at once proved its glory and destruction. It became the scene of the surrender of Lord Cornwallis in 1781, but by the war it was reduced to a mass of ruins, and has never since regained the trade which it once had. It was once a corporation and had a council, and the town seal is still preserved. The accom- panying cut is from a wax impression given me by the late Captain Robert A. Bright, who had the original seal in his possession.

1639 John Utie, Jr. born about 1619 London. He was baptized in St. Andrew's Holborn Parish. He repatented his fathers 1250 acres in 1638. So, Thomas Gibson d. 1652 did NOT marry Elizabeth Booth dau of Robert. His giving her the land and heifer is unexplained. However, a Thomas Gibson had several illegitimate children to take care of prior to 1700's, as per parish records for New Kent County (1695/6 and 1696) Perhaps this explains why he gave land to Elizabeth Booth. Were they his children or was he just providing for their welfare? The probability is that they were his children out of wedlock.

Note: Utimaria connections: VA. People sought for an explanation of this sudden change in Governor Nicholson, and found it thus. A few miles from Williamsburg, at the mouth of King's Creek, once known as "Utimaria," the home in early colonial days of Capt. John Utie, resided Maj. Lewis Burwell (1) and his bevy of charming daughters, one of whom infaturated the Governor. The first name of this lowland beauty is unknown; but tradition represents her as of that ravishing type of beauty which, in another fair Virginian, roused the anonymous poet to alliterative verse:
"May mild, meridian moonbeams mantle me with laughing, lisping Lucy Lightfoot Lee."
Moonbeams suggest lunacy, however, as well as love, and Miss Burwell would not accept the mad Governor. Thereupon, Nicholson imagined that Dr. Archibald Blair, brother of the President, was his rival, and "conceived the strongest objections to him and all his relatives." ________________ (1) Lewis Burwell, the second of the name, who married Abigail Smith, niece and heiress of Col. Nathaniel Bacon, of King's Creek.

1626 April 25th Deed [Genealogies of Virginia Families, Volume II, Jefferson Family, page 432] In a record of the Virginia General Court for April 25, 1626, mention is made of Capt. John JEFFERSON being then in the West Indies, and permission was granted to Captain John UTIE to occupy and settle his land, on his promise to indemnify Capt. JEFFERSON, if he should ever return. (Va Magazine XXX, p. 49). This John JEFFERSON was the first named John JEFFERSON, a London merchant, that appeared in Virginia cira 1618 in the Bona Nova and represented Flowerdew Hundred in the first General Assembly, which convened at Jamestown July 20, 1619. He remained in the colony abt 3 years, and returned to England, where in June 1622, he testified before the London Company against Capt. John Martin. While in Virginia he was made a lieutenant, and in England in 1623 was appointed by the King on the Commission to make report as to conditions in Virginia. Having resided over three years in Virginia, he was granted by the Company 250 acres at Archer's Hop for "his personal adventure". He was also mention as "He interested himself in St. Christopher's Island, and with Sir Thomas WARNER and Ralph Merrifield, London Merchants, began the colonizing of St. Christopher in 1623. He left England in the Great Hopewell, in October 1623, and came to that Island in March, 1624. Capt. John JEFFERSON was reportedly the son of John JEFFERSON, Pittistrie, Suffolk yeoman, and that about 1656 Capt. Jeaffreson purchased the manor of Dillingham, Cambridgeshire. His will was dated Sept 4, and proved October, 1660. He had brothers, from one of whom President JEFFERSON may have descended." Note: Of interest is the connection of Thomas JEFFERSON and Thomas TOTTY in Henrico Co., VA as owning land adjacent to each other in late 1690's and early 1700's.

(Signed) George YEARDLEY Jo: PORY, Sect." The certificate of Thomas PARKER, Mayor of Bristol, gives the names of fifty-eight passengers on the SUPPLY when cleared. There is extant some correspondence between William TRACY and John SMYTH of Nibley concerning certain person left behind on account of the crowded condition of the ship. Whether any of these were put ashore during the week the SUPPLY lay in the Severn awaiting favorable weather is not known. If none were put ashore after the ship was cleared the loss on the voyage amounted to eight sourls, a not uncommon percentage in the vessels of that period. The Town and Hundred of Berkeley on James River---the present landing for this ancient plantation is known as Harrison's Landing--had been previously under the management of Captain WOODLEFFE, but the SUPPLY brought the revocation of his appointment and the new commissions of William TRACY and George THORPE to be governors of Berkeley Town and Hundred. TRACY also brought a letter of instruction and advice concerning Virginia affairs from Richard BERKELEY and John SMYTH."

This land acquired by Gibson by bill of sale from John UTIE dated 12 Sept Sept 1640. The land being on the N side of Bryrie Swamp adj the land belonging to Ro Bouth and now in possession of James White. The 50 acres lying near the spring called the Indian Spring on the N side thereof and adjs the land of said Tho Gibson. Upon N. side of Queens Cr., near land of John UTY & John Bell. This land was part of a devident of Capt. John UTY, who assigned it to John Lylly & John Bell, who assinged it to Richard Major, who assigned it Richard Jones, who assigned it to Robert Bouth, who assigned it to Owen Loyd, & by John Broach, Atty. for sd Loyd, conveyed to John Hartwell. Due unto sd Green by intermarriage wiht the relict of sd Hartwell, who also dyed, and said land now becoming due to sd Green.
